Terms of Service

1. Acceptance of terms

By creating an account or using TourixAI (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding contract between you and TourixAI.

2. Description of service

TourixAI is an AI-powered platform that generates social media post images and captions for travel agencies and related businesses. The Service uses third-party AI models (including OpenAI) to generate content based on your inputs.

TourixAI is designed primarily for social post generation workflows. Other publishing surfaces may not be supported in every workflow.

3. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • Each account is for one business or individual. You may not share accounts.
  • You must be at least 18 years old to use the Service.
  • We reserve the right to terminate accounts that violate these terms.

4. Plans, payments, and billing

Plans are sold directly by TourixAI. Plans are paid in advance, by cash or bank deposit, and are activated once payment is received. We never collect card details.

  • Starter (EUR 49.99/month): 5 posts per calendar month, 1 brand kit, no watermark.
  • Pro (EUR 99.99/month): 15 posts per calendar month, 1 brand kit, no watermark.
  • Business (EUR 219.99/month): 40 posts per calendar month, 3 brand kits, no watermark.
  • Extra posts for the current month can be added on request; they count for that month only.
  • Plans are prepaid for a fixed period, such as 1, 3, 6 or 12 months. Your plan's end date is shown on your Billing page.
  • Plans do not renew automatically. To continue after the end date, contact us to renew. When a plan ends, post generation stops; your saved posts and brand kit are kept.
  • Unused posts do not roll over to the next month.
  • Prices are shown in EUR.
  • If you delete your account, any remaining time on your plan ends immediately.
  • Payments are non-refundable, including for unused time or unused posts, except where required by applicable law.

5. Acceptable use

You may not use TourixAI to:

  • Generate content that is fraudulent, misleading, or misrepresents travel products
  • Generate content that violates any applicable law or regulation
  • Violate the terms of any third-party platform or distribution channel
  • Attempt to reverse-engineer, scrape, or abuse the Service's APIs
  • Resell or white-label the Service without written permission
  • Use the Service outside its supported output formats or workflows

6. AI-generated content

You acknowledge that:

  • TourixAI uses AI models that may occasionally produce inaccurate, inconsistent, or unexpected output. You are responsible for reviewing all generated content before publishing.
  • You own the posts you generate using TourixAI and may use them commercially for your own travel agency.
  • You may not claim that AI-generated images are unmodified original photographs where doing so would be materially misleading to consumers.
  • Generated images are derived from AI models trained on broad internet data. TourixAI does not warrant that generated content is free from third-party intellectual property claims.

7. Intellectual property

TourixAI retains all rights to the platform, its software, and its branding. You retain all rights to your agency data (name, logo, brand assets) that you upload. Generated post images and captions are owned by you upon generation, subject to the acceptable use restrictions above.

8. Limitation of liability

To the maximum extent permitted by law, TourixAI is provided “as is” without warranty of any kind. We are not liable for:

  • Loss of revenue or profits resulting from use of the Service
  • Platform rejections or policy violations by third-party distribution channels
  • Service interruptions due to third-party providers (OpenAI, Cloudinary, Vercel)
  • Any indirect, incidental, or consequential damages

Our total liability to you is limited to the amount you paid to TourixAI in the 3 months preceding the claim.

9. Termination

You may delete your account at any time from the Settings page. We may suspend or terminate your account if you breach these terms, with or without prior notice. Upon termination, your data is deleted in accordance with our Privacy Policy.

10. Changes to these terms

We may update these terms. Material changes will be communicated by email at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing law

These terms are governed by the laws of the European Union and applicable member state law. Disputes shall be resolved in the courts of the jurisdiction in which TourixAI is registered.
