Terms of Service

1. Acceptance of terms

By creating an account or using TourixAI (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding contract between you and TourixAI.

TourixAI is offered only to businesses (travel agencies, tour operators and similar) for use in their trade. By creating an account you confirm you act for a business and not as a consumer. Consumer protection laws that apply only to consumers, including withdrawal rights, therefore do not apply.

2. Description of service

TourixAI is an AI-powered platform that generates social media post images and captions, and short AI-generated travel films made with third-party video models (through Replicate, or Higgsfield), for travel agencies and related businesses. The Service uses third-party AI models (including OpenAI) to generate content based on your inputs.

TourixAI is designed primarily for social post generation workflows. Other publishing surfaces may not be supported in every workflow.

If you connect Instagram or Facebook accounts, TourixAI publishes the posts you choose, at the times you choose, through our publishing provider (Post for Me), and reads their results. You remain responsible for what is published from your accounts and for following each platform's rules. A boost you start is an ad bought from Meta with your own ad account, under Meta's terms; Meta charges you directly and TourixAI does not handle that payment.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• Each account is for one business. You may not share accounts.
• You must be at least 18 years old to use the Service.
• We reserve the right to terminate accounts that violate these terms.

4. Plans, payments, and billing

Plans are sold directly by TourixAI. Plans are paid in advance, by cash or bank deposit, and are activated once payment is received. We never collect card details.

• Starter (EUR 39/month): 15 images per monthly plan cycle (each an ad or a carousel, one finished design each), 3 travel films per monthly plan cycle (each 15 s and counted as one film whatever its length; Standard quality (480p) with sound), 1 brand kit, no visible watermark.
• Pro (EUR 99/month): 35 images per monthly plan cycle (each an ad or a carousel, one finished design each), 8 travel films per monthly plan cycle (each 15 s and counted as one film whatever its length; Standard quality (480p) with sound), 1 brand kit, no visible watermark.
• Business (EUR 249/month): 90 images per monthly plan cycle (each an ad or a carousel, one finished design each), 20 travel films per monthly plan cycle (each 15 s and counted as one film whatever its length; HD (720p) with sound), 3 brand kits, no visible watermark.
• The founding offer ended on 20 October 2026. Businesses that joined as founding members now pay the regular prices above, like every other client.
• You can make at most 3 films a day, one at a time.
• Add-on credit is a prepaid balance in euros, valid until the end of the plan month after the one in which it is added. Once your plan's monthly allowance is used, each extra ad costs EUR 2 and each extra film costs the price shown on your Billing page (prices exclude VAT). Unused credit expires and is not refunded, except where the law requires.
• Plans are prepaid monthly; Enterprise may agree longer prepaid terms. Your plan's end date is shown on your Billing page.
• Plans do not renew automatically. To continue after the end date, contact us to renew. When a plan ends, post and film generation stops; your brand kit is kept, and your ads and films stay in your library as described in section 7.
• Your images and films reset at the start of each plan month. Unused images and films do not carry over to the next plan month.
• Prices are shown in EUR and exclude VAT. Any applicable VAT will be added, and the total amount due will be confirmed before you pay.
• If you delete your account, any remaining time on your plan ends immediately.
• Payments are non-refundable, including for unused time, images or films, except where required by applicable law. Nothing in these terms limits any cancellation, withdrawal, refund, or other rights that cannot be excluded under applicable law.

5. Acceptable use

You may not use TourixAI to:

• Generate content that is fraudulent, misleading, or misrepresents travel products
• Generate content that violates any applicable law or regulation
• Violate the terms of any third-party platform or distribution channel
• Attempt to reverse-engineer, scrape, or abuse the Service's APIs
• Upload photos, logos or other material you do not own or have permission to use (for example a hotel's photos without the hotel's consent)
• Resell or white-label the Service without written permission
• Use the Service outside its supported output formats or workflows
• Advertise prices, inclusions, dates or availability that are not real. Travel ads must show the total price, including mandatory taxes and fees, as consumer and package-travel law requires
• Depict real, identifiable people without their consent, or run political or social-issue campaigns
• Remove AI labels or provenance metadata from generated content

5a. Your content and responsibility

You are responsible for your prompts, uploads and how you use outputs, including any trademarks, hotel names, logos, buildings, artworks, events or recognisable people they show. Do not request ads that depict a real person, or use a third party's brand, without permission. AI may render real places, hotels and landmarks inaccurately; you must make sure an ad does not misrepresent what you actually sell. You will indemnify TourixAI against third-party claims arising from your content or your use of outputs.

6. AI-generated content

You acknowledge that:

• TourixAI uses AI models that may occasionally produce inaccurate, inconsistent, or unexpected output. You are responsible for reviewing all generated content before publishing.
• As between you and TourixAI, we assign to you any rights we have in the images, films and captions you generate. AI output may not be protected by copyright, and similar output may be generated for others.
• Our images and films are AI-generated. Do not remove information identifying them as AI-generated. Where the law or a platform's rules require it (including Article 50(4) of the EU AI Act for realistic depictions of real places, people, buildings or events), you must clearly disclose that the content is AI-generated when you publish it, for example with the platform's AI label or the words ‘Image created with AI’.
• You may not claim that AI-generated images are unmodified original photographs where doing so would be materially misleading to consumers.
• Generated images are derived from AI models trained on broad internet data. TourixAI does not warrant that generated content is free from third-party intellectual property claims.

7. Intellectual property and storage of your ads

TourixAI retains all rights to the platform, its software, and its branding. You retain all rights to your agency data (name, logo, brand assets) that you upload. Rights in generated images, films and captions are assigned to you as described in section 6, subject to the acceptable use restrictions above.

Your ads and films stay in your library for as long as your account is active; nothing is deleted because of its age. You can delete any of them yourself at any time: deleted items are removed from our servers and our storage provider.

7a. Copyright complaints

We respect intellectual property rights. If you believe material shown or stored through TourixAI infringes your copyright, send a written notice to our designated copyright agent with: your physical or electronic signature; the work you say is infringed; the material you say infringes it, with enough detail for us to find it (such as its link); your address, telephone number and email; a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.

Designated copyright agent:

When we receive a valid notice we remove or disable access to the material and tell the user who uploaded or generated it. That user may send a counter-notice with the details the law requires; if they do, we may restore the material after 10 to 14 business days unless the complainant tells us they have started court action. We close the accounts of repeat infringers in appropriate circumstances. A false notice or counter-notice can make you liable for damages.

8. Limitation of liability

To the maximum extent permitted by law, TourixAI is provided “as is” without warranty of any kind. We are not liable for:

• Loss of revenue or profits resulting from use of the Service
• Platform rejections or policy violations by third-party distribution channels
• Service interruptions due to third-party providers (OpenAI, Replicate, Higgsfield, Cloudinary, Vercel)
• Any indirect, incidental, or consequential damages

Our total liability to you is limited to the amount you paid to TourixAI in the 3 months preceding the claim.

Nothing in these Terms limits liability for fraud, gross negligence or wilful misconduct, or any liability that cannot be limited by law.

9. Termination

You may delete your account at any time from the Settings page. We may suspend or terminate your account if you breach these terms, with or without prior notice. Upon termination, your data is deleted in accordance with our Privacy Policy.

10. Changes to these terms

We may update these terms. Material changes will be communicated by email at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing law

These terms are governed by the laws of Kosovo. Disputes shall be resolved in the competent courts of Kosovo, except where applicable law gives you the right to bring a claim in another court. This choice of law does not remove any mandatory protections that cannot be excluded under the law that otherwise applies.
